Limitation of Liability | AgGenomics agrees to use its reasonable endeavours to perform the services adequately and to industry standards.
However, except as implied by statute or expressly agreed in writing by AgGenomics, any and all liability for the services performed and material supplied in connection with those services by AgGenomics is excluded.
The liability of AgGenomics for a breach of any condition or warranty implied by law is limited at AgGenomic's option to the re-supply of the services or payment of the cost of having the services supplied again.
Except as implied by statute, all other liability, including for physical or financial consequential loss or damage (including, without limitation, loss of revenue, loss of profits or opportunity cost) and whether arising from negligence or in any other way is excluded.
